
Small Claims Matters
The Small Claims Court is a branch of the Superior Court of Justice, and handles nearly half of all civil claims in the province of Ontario. The Court is intended to provide a more accessible and less formal way of litigating disputes, where the amount of money or value of property in issue does not exceed $35.000

Suing In Small Claims Court starts with issuing a Plaintiff's Claim Document and serving the Plaintiff's Claim on the Defendant. After service upon the Defendant, an Affidavit of Service is filed with the court. While these steps seem straight forward, there are procedural errors that may negatively impact your claim such as: missed deadlines, filing incomplete and/or incorrect forms, etc.

IMPORTANT: The Limitations Act, 2002 sets out a basic limitation period of two years from the day on which the claim was discovered or ought to have been discovered. Clients need to keep in mind that Small Claims can take between six to 18 months from the time of filing to the trial date. Which means that the sooner claim is initiated, the sooner we will try to come to a beneficial resolution, be that through means of negotiations, mediation or trial.
